Terms of Service

These Terms of Service (the "Terms") govern your use of the PikaBot Discord bot, the website at pikabot.win, the licensing system, the wallet feature, and any related services (collectively, the "Service"). By topping up your wallet, redeeming a code, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not purchase or use the Service.

1. Nature of the Service

PikaBot is an independent network-protocol client and automation toolkit, provided for educational and research purposes. The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied. We make no guarantee of uptime, feature availability, compatibility with any third-party software or platform, or that the Service will be uninterrupted, secure, or error-free. Third-party protocols may change at any time, and we do not guarantee continued functionality.

2. Eligibility

• You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to make a purchase or use the Service.
• You must own the Discord account and any third-party account you bind to the Service.
• You agree not to use the Service in any jurisdiction where it would be illegal.

3. User responsibility

By using the Service, you acknowledge and agree that:

• You are solely responsible for how you use this software, including which third-party software or platform you choose to use it with.
• You will comply with all applicable laws and the terms of service of any third party you interact with.
• Use of automation software with an online service may violate that service's terms of use and could result in account suspension, termination, content loss, or other action by that operator.
• We assume no liability for any consequences arising from your use of this software, including but not limited to account bans, data loss, monetary loss, or legal action by third parties.

4. Wallet credits

The wallet stores a balance of "PikaBot credits" (denominated in U.S. cents) linked to your Discord ID. These credits are a strictly virtual, closed-loop digital balance intended solely for use within the PikaBot ecosystem. You acknowledge and agree that:

• Credits have no real-world monetary value, are not legal tender, and are not an investment.
• Credits cannot be exchanged, redeemed, or "cashed out" for fiat currency, cryptocurrency, or any other real-world consideration.
• Credits are non-transferable between user accounts. License codes generated from credits may be redeemed against an account identifier you control or shared one-time as a gift; bulk resale or commercial redistribution is prohibited.
• You are purchasing a limited license to use the credits within the Service, not ownership of the credits.

Top-ups are processed by Stripe; we do not store your card details. Wallet balance and license codes are consumable digital goods delivered immediately upon successful payment.

5. Refunds — all sales final

Because wallet credits and license codes are consumable digital goods delivered instantly, all top-up transactions are final and non-refundable. By completing a top-up you agree that:

• You will not receive a refund for unused wallet balance.
• You will not receive a refund for redeemed or unredeemed license codes.
• You will not receive a refund due to changes in third-party protocols, Service maintenance, downtime, or the Service ceasing to function.
• You will not receive a refund if your account is later suspended for violating these Terms.
• You will not receive a refund on the basis of any action taken by a third party (including bans, content loss, or platform changes) against an account you control.

In rare cases (duplicate charges, billing errors, payment-processor failure) we may issue a refund at our sole discretion. To request one, email support@pikabot.win with your Discord ID and the Stripe receipt within 30 days of the charge. Please contact us before opening a chargeback — most issues can be resolved directly within one business day.

6. Chargebacks

If you initiate a chargeback or payment dispute without first contacting us at support@pikabot.win, you agree that:

• Your wallet balance and any associated license codes may be revoked, including time already redeemed against an account identifier.
• Your access to the Service may be terminated, including the bot, the manage page, and any Discord roles tied to license status.
• We may decline future top-ups from the same Discord account, payment method, email, or IP.

We will provide Stripe with our records of the transaction, including the timestamp and IP at which you accepted these Terms, to defend the dispute.

7. Account suspension, bans, and forfeiture

We reserve the right, at our sole discretion, to suspend, ban, or terminate any account — with or without notice — for violating these Terms, including but not limited to: suspected fraud, chargeback abuse, distributing, sharing, or publishing a modified, repackaged, or cracked version of the PikaBot client, attempting to reverse-engineer or defeat the license verification, or any conduct we determine to be harmful to the Service or its users.

When an account is banned or terminated:

• Your access to every part of the Service is revoked, including the bot, the management page, and any Discord roles tied to license status.
• Your active licenses stop validating immediately and the client will no longer be authorized, regardless of any remaining time on those licenses.
• Your wallet balance is frozen, and any remaining credits and unredeemed license codes are forfeited. Frozen balances are not refunded or paid out while a ban is in effect.
• License time already redeemed may be revoked.

Bans are issued at our sole discretion. We may, but are not obligated to, lift a ban and restore a frozen balance if we determine the ban was issued in error.

8. Acceptable use

You agree not to:

• Resell, sublicense, or commercially redistribute license codes, except by directly redeeming a code you bought against another user's account identifier as a one-time gift.
• Distribute, share, publish, host, or make available any modified, repackaged, cracked, or unauthorized version of the PikaBot client or its components.
• Reverse-engineer, decompile, or attempt to defeat the license verification or any other technical measures.
• Use the Service to harass, defraud, or interfere with other users.
• Use stolen or unauthorized payment methods. We cooperate with law enforcement in fraud cases.

Violation may result in suspension, ban, or termination under Section 7, without refund.

9. Third-party software and accounts

PikaBot is an independent project and is not affiliated with, associated with, authorized by, endorsed by, or in any way officially connected to any third-party game developer, publisher, platform, or operator. Use of automation software with a third-party service may violate that service's terms of use. You are solely responsible for any consequences imposed by a third-party operator on an account you control, including bans, content loss, or legal action. We do not refund licenses on the basis of any such third-party action.

10. Indemnification

You agree to indemnify, defend, and hold harmless PikaBot and its operators from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any law or third-party rights.

11. Intellectual property

The PikaBot client, server software, brand, and supporting materials were developed independently through the operator's own protocol analysis and engineering. The Service does not contain proprietary code, assets, or copyrighted materials belonging to any third party. All rights in the Service are reserved by the operator.

12. Privacy

We store the minimum data needed to run the Service: your Discord ID, the account identifiers you bind, license expiry timestamps, wallet balance, ledger entries, the timestamp and IP at which you accepted these Terms, and (when collected by Stripe) the email used at checkout. Telemetry pings sent by the client (module name, OS, version, hashed identifiers) are kept for 30 days and used only to operate and improve the Service. We do not sell or share data with third parties except as required to process payments or comply with law.

13. Disclaimers and limitation of liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OPERATION. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE OPERATOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR ACCOUNTS, ARISING OUT OF OR RELATED TO THE SERVICE. OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID IN THE 90 DAYS PRECEDING THE CLAIM.

14. Governing law and severability

These Terms are governed by the laws of the operator's jurisdiction, without regard to its conflict-of-laws rules. If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

15. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted on this page with a revised "Last updated" date and will require re-acceptance on your next wallet top-up. Continued use of the Service after changes constitutes acceptance.
